Superior Court Dismisses Case Finding No Proximate Cause
Beckstedt & Associates obtained a summary dismissal just two days before trial in a hotly contested wrongful death case in which a local worker was killed when a slab he was unloading in St. Thomas fell on top of him. Our client was a Florida wholesaler of stone slabs who had sold the slabs in Florida to a St. Thomas retailer. The retail purchaser had picked up the slabs in Florida and then shipped them to their location in the U.S. Virgin Islands. The trial court agreed that the Florida wholesaler was not the proximate cause of the plaintiff’s injuries which occurred in St. Thomas while the shipment was being unloaded.
