March 2005: Attorney Beckstedt Wins Enforcement of Arbitration Agreement Requiring Arbitration of Tort Claims Against Third Party. Representing a third party beneficiary to an arbitration agreement between a plaintiff/employee and his employer, Attorney Beckstedt sought to compel arbitration of the toxic tort claim filed in the local trial court. The arbitration agreement is part of a newly established company-wide alternative dispute program. Plaintiff challenged the enforceability of the agreement on grounds it was unconscionable and violated local laws prohibiting arbitration of tort-based claims. In a published decision, the Court agreed that the arbitration agreement was enforceable and compelled arbitration.
