In 2008, Carl Beckstedt tried the first known Virgin Islands personal injury claim to an arbitrator pursuant to his client’s recently implemented company-wide alternate dispute resolution program. The award was returned for the defense denying all claims. The matter involved a Claimant who alleged permanent injuries as a result of negligent housekeeping by a premises owner during new construction of a refinery process unit. Liability issues involved premises liability, control over the work of an independent contractor and OSHA regulations.
